Terms of Use and Privacy Notices for the Customer Portal of Seibert Group

These terms apply to the registration and use of the customer portal at customer.seibert.group. Additional terms for events apply to events. You can find plain-language answers to common questions in our FAQ.

Part 1 – Terms of Use

1. Scope and contracting party

(1) These terms apply to the registration and use of the customer account at customer.seibert.group (hereinafter the “customer account” or “portal”) and to access to the content and services provided through it.

(2) The operator and contracting party is Seibert Group GmbH, Luisenstraße 37–39, 65185 Wiesbaden, Germany (hereinafter “we” or “us”). Contact: see Legal Notice and datenschutz@seibert.group.

(3) Supplementary terms apply to individual offers and take precedence over these terms to the extent they differ: the event terms for events, and the shop terms linked there for the merch shop.

2. The customer account (central access)

(1) customer.seibert.group is the central customer account of Seibert Group. Through this single account you access our content, applications, and events, and manage your digital collaboration with us. It is the unified single sign-on access to the customer-facing services under the seibert.group domain.

(2) The customer account is the technical vehicle for your contractual relationships with us. It gives you access to content and booked services and lets you manage your settings.

(3) Access is non-transferable. You are required to provide truthful information when registering.

3. Registration and sign-in

(1) Registration requires a valid business email address. Addresses from free email providers (e.g. Gmail, Hotmail) and disposable/temporary addresses are not accepted.

(2) Sign-in is passwordless: after entering your email address, you receive a one-time sign-in link at that address; alternatively, you can sign in using “Sign in with Google.” Access to your email inbox or Google account therefore grants access to your customer account — secure these accounts accordingly.

(3) For security reasons, you actively confirm the sign-in link in an additional step. If you receive a sign-in link without having requested it, you can ignore it.

4. Services and consideration

(1) Through the portal we provide:

  • free exclusive content (e.g. expert videos, guides, templates, recordings, downloads),
  • paid services, in particular the booking of events and the merch shop.

(2) Free content in exchange for data use. You receive access to the free exclusive content in exchange for consenting to the use of your data for personalization and marketing purposes (Sec. 5). This consent is the consideration for the free access (a contract for digital content, German Civil Code (BGB) Sec. 327(3)) — comparable to other providers offering their content for money. Without this consent, we cannot provide the free exclusive content.

(3) Paid services in exchange for payment. For events and the merch shop, you pay a price in money. The personalization/marketing consent under Sec. 5 is not required for and not a precondition of these services; you can book them independently of that consent.

5. Personalization and marketing

(1) By giving your consent, you allow us to link your activity on the websites and applications under seibert.group to your identity, build an interest profile from it, personalize content for you, and reach out to you with relevant offers. Details are set out in Part 2 (Privacy Notices).

(2) Withdrawal. You can withdraw your consent at any time in your settings (customer.seibert.group/settings). Withdrawal takes effect for the future and is as easy as giving consent.

(3) Effect of withdrawal. Withdrawal does not affect your access to paid services and content you have already acquired (these are based on your payment, not on your consent). However, because your consent is the consideration for the free content access, withdrawing it ends your free access to the exclusive content — just as a paid offer ends when payment stops. Your customer account remains in place. You can give your consent again at any time and will regain access.

(4) While signed out, we do not link any activity to your profile.

6. Phone calls: recording and analysis

(1) Which calls are recorded. We do not record all calls. The focus is on calls in the getting-to-know and exploration phase (“discovery”) — those whose outcomes we need to pass on and coordinate internally — and on calls we use to train our staff. In day-to-day collaboration, in ongoing projects, and while delivering our services, we generally do not record; there, we do so only where this has been agreed with the project participants. Only the call itself is recorded, and only where consent for this has been given. Without consent, the call takes place without any recording.

(2) What happens with it. The recording is automatically converted into text (transcription) and analyzed with AI support, in order to summarize what was discussed: topics, open points, and agreed next steps. Our staff use this summary as the basis for structured follow-up documentation of the call in our customer relationship management system (CRM), so that as little as possible from the conversation is lost. We also use individual recordings to train our staff. We do not use them to train AI models. We do not take decisions about you with legal or similarly significant effect on a solely automated basis (Art. 22 GDPR).

(3) Two paths to consent. Consent can exist via either of two independent paths:

  • Through your customer account. During registration you can give your consent to the recording and analysis described in paragraphs 1 and 2. It is given separately and distinctly from the other declarations. You can view and change the status of your consent at any time in your settings (customer.seibert.group/settings).
  • At the start of the call. Independently of any customer account, we point out the intended recording at the start of a call and obtain your consent. This path applies in particular to people who do not have a customer account with us.

Neither path replaces the other: even where consent exists through your customer account, you can object to the recording for an individual call.

Where possible, we additionally point out an ongoing recording during the call itself, or rely on the indicator of the system in use — in video calls, for example, the visible recording indicator.

(4) Other participants on the call. Recording requires the consent of all participants for the specific call (German Criminal Code (StGB) Sec. 201). If other people are listening in or join during the call, please let us know; we do not record without their consent.

(5) Voluntary nature. Consent to recording is voluntary. It is not a precondition for your customer account, for access to free or paid content, or for using our services, and it is not part of the consideration under Sec. 4(2). Without consent, we speak with you on the phone without recording.

(6) Objection and withdrawal. You can object or withdraw at any time:

  • for a single call — to the person you are speaking with, at the start of or during the call; the recording is then not started, or is stopped and deleted,
  • generally — in your settings (customer.seibert.group/settings) or by sending a message to datenschutz@seibert.group.

Withdrawal takes effect for the future and is as easy as giving consent. At your request, we additionally delete existing recordings, transcripts, and analyses, unless statutory retention obligations require otherwise.

(7) Retention. We delete the audio recording no later than 30 days after the call. We keep the transcript and the analysis in our CRM for the duration of the business relationship and delete them afterwards, unless statutory retention obligations require otherwise. Details are set out in Part 2.

7. Formation of the contract

(1) The display of content and services is not a binding offer but an invitation to submit an offer.

(2) By completing the registration or order process, you submit a binding offer. The contract is formed upon our confirmation or upon activation of your access.

8. User obligations

(1) You will not misuse the portal, in particular you will not share your access credentials or sign-in links with others, and you will not reproduce protected content without authorization.

(2) The content provided is protected by copyright and intended solely for your own use.

9. Term, account deletion, and suspension

(1) The usage agreement runs for an indefinite term. You can delete your account yourself at any time in the portal; no notice or justification is required.

(2) You control the processing yourself at any time:

  • Sign out — while signed out, we do not link any activity to your profile.
  • Withdraw personalization — ends profile building and, with it, your free content access; your account remains in place, and you can reactivate at any time (Sec. 5(3)).
  • Delete profile — removes your data (Delete Profile).
  • Delete profile & block email — removes your data and prevents future registration with that address (Delete & Ban Email).

(3) Email block. If you block your email address, we retain only that address, in blocked form, even after deletion — solely to enforce the block. You can have the block lifted by sending a message to datenschutz@seibert.group.

(4) Deletion ends your access to the protected content. Events already booked and paid services already acquired remain unaffected.

(5) We may suspend accounts for serious or repeated violations of these terms.

10. Liability

(1) We are liable without limitation for intent and gross negligence, and for damages arising from injury to life, body, or health.

(2) For simple negligence, we are liable only for the breach of a material contractual obligation (cardinal obligation) — one whose fulfillment is essential to the proper performance of the contract and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical for this type of contract.

(3) Liability is otherwise excluded. Liability under the German Product Liability Act remains unaffected.

11. Changes to these terms

We may change these terms with effect for the future. We will notify you of changes in good time, generally by email. If you do not object within six weeks of receiving the notice of change, the amended terms are deemed accepted; we will draw your attention to this consequence separately in the notice.

12. Consumer dispute resolution

(1) The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr. Our contact details are set out above.

(2) We are not obligated, and are not willing, to participate in dispute resolution proceedings before a consumer arbitration board.

13. Final provisions

(1) German law applies.

(2) Should individual provisions be invalid, the validity of the remaining provisions is unaffected.

Part 2 – Privacy Notices

Controller

The controller is Seibert Group GmbH, Luisenstraße 37–39, 65185 Wiesbaden, Germany. For questions about data protection: datenschutz@seibert.group

These notices cover processing relating to your customer account and the services provided through it. For general data processing on our websites, other embedded services, and your data subject rights in detail, our general privacy notices apply in addition.

Legal bases for processing

  • Performance of a contract (Art. 6(1)(b) GDPR): creating and maintaining your customer account, providing purchased/booked services, managing the business relationship, sending transactional messages (sign-in link, booking and account confirmations).
  • Consent (Art. 6(1)(a) GDPR): linking your activity to your identity for personalization and marketing purposes (Sec. 5, Part 1). For free content, this consent is at the same time the contractual consideration; it remains revocable at any time (consequence: Part 1, Sec. 5(3)).
  • Consent (Art. 6(1)(a) GDPR, German Criminal Code (StGB) Sec. 201): recording, transcription, and AI-supported analysis of phone calls (Sec. 6, Part 1). This consent is separate from the personalization consent, voluntary, and revocable at any time; it is not a precondition for your account, content, or services.
  • Legal obligation (Art. 6(1)(c) GDPR): e.g. retention of invoices under tax and commercial law.
  • Legitimate interest (Art. 6(1)(f) GDPR): improvement of our offering through aggregated usage analysis not linked to your profile, to further develop our services. Profile-based analysis takes place exclusively on the basis of your consent (see “Two processing layers”).

Two processing layers – kept separate

(a) Operating the account and applications (lit. b). We process which services you use through your account in order to provide them to you, manage your collaboration with us, and maintain your account in our administrative systems. This processing is necessary for operation.

(b) Cross-channel personalization (lit. a). Only on the basis of your consent do we link your activity across domains into an interest profile and use it for personalization and sales outreach. Opt-out as described in Part 1, Sec. 5/Sec. 9.

What happens while you are signed in and have given consent

As long as you are signed in and have given consent, we link your activity across the websites and applications on the seibert.group domain to your identity. Specifically:

  • We record which content you access, which pages you visit, which videos you watch, and which documents you download, and attribute these events to your profile. For this we use the analytics platform PostHog.
  • From this data we build an interest profile and infer which of our products and services might interest you.
  • We use this profile to determine the timing and channel for personal outreach by our sales team. We use automated workflows for this processing.
  • Linking occurs only while you are signed in. As soon as you sign out — on the respective website, in the application, or centrally at customer.seibert.group — we no longer link your activity to your profile.

Phone calls: recording, transcription, and AI analysis

Where consent under Part 1, Sec. 6 exists, we process phone calls with you as follows:

  • Which calls: not all — primarily calls in the getting-to-know and exploration phase (“discovery”) and calls used to train our staff. In day-to-day collaboration, in projects, and while delivering our services, we generally do not record (Part 1, Sec. 6(1)).
  • Data processed: the audio recording of the call, the transcript generated from it, and the summary derived from it covering topics, open points, and agreed next steps. In addition, call metadata (time, duration, phone numbers involved, staff involved) and the documented status of your consent.
  • Purpose: structured follow-up documentation of the call by our staff, maintaining the customer relationship in our CRM, and quality assurance and training in how we conduct calls. We do not use recordings or transcripts to train AI models — neither we nor our service providers.
  • How we process: transcription and analysis are performed automatically using AI services that we engage as processors. These providers may not use your data for their own purposes or to train their own models. You can find which providers we specifically use and where they process data in our service provider overview.
  • Results are reviewed by humans: the AI analysis produces a draft; our staff remain responsible for the follow-up documentation. There is no solely automated decision with legal or similarly significant effect on you (Art. 22 GDPR).
  • Consent of all participants: we only record where all participants in the call have consented for that specific call (German Criminal Code (StGB) Sec. 201).
  • Retention: audio recording for a maximum of 30 days; transcript and analysis for the duration of the business relationship in our CRM (see “Retention period and deletion”).
  • Withdrawal: at any time for an individual call, to the person you are speaking with, and generally in your settings (customer.seibert.group/settings) or by sending a message to datenschutz@seibert.group (Part 1, Sec. 6(6)).

Surveys and polls (Seibert Polls)

Through your customer account and the Seibert Polls app, you can take part in surveys and polls, for example to give us feedback on events or products. In doing so, we process your name, your email address, your display name, the time of your participation, and your answers in order to run and evaluate the survey and to prevent duplicate votes. The legal basis is our legitimate interest in customer feedback (Art. 6(1)(f) GDPR); where we use your participation to contact you personally, this is based on the consent you have given in your customer account (Art. 6(1)(a) GDPR). Other participants only see the overall results; only we, as the survey organizer, see your individual answers. For anonymous surveys, we only store the fact that you took part. The surveys run on our own infrastructure in the EU, without external analytics services, and 90 days after a survey ends, we automatically remove the link to your person.

Use of technologies on your device (Sec. 25 TDDDG)

For the functions described above, we set and read information on your device (e.g. cookies, local storage). To the extent this is not strictly necessary for operation, it occurs only with your consent, which you can withdraw at any time.

Categories of data processed

  • Email address (required): authentication and sign-in link.
  • Account and usage data: which services you use; while signed in and with consent given, your activity on seibert.group.
  • Contract and payment data: for paid services (details in the respective supplementary terms).
  • Profile information (optional): voluntary information such as name or phone number.
  • Call data (only with consent): recording, transcript, analysis, and metadata of phone calls with us (Part 1, Sec. 6).

Recipients / processors

We do not share your data with third parties for their own advertising purposes. We use service providers who process personal data exclusively on our instructions and on our behalf (processors, Art. 28 GDPR) — including for hosting and operations, database, analytics, customer relationship management (CRM), workflow automation, sign-in, and running events. We operate part of these systems on our own servers in Germany (including our CRM system, Twenty), without third-party access. You can find the current overview of the service providers we use, their function, and where they process data in our service provider overview.

Kegon AG — a company affiliated with us — supports us, on our instructions, in running events and delivering our services, and receives access to the relevant data where necessary. It processes this data exclusively on our behalf and not for its own purposes.

We have entered into the required agreements with all processors.

Data processing outside the European Union

We primarily process your data within the EU. Our database is operated in Frankfurt, and analytics and automation take place within the EU or on our own infrastructure. For hosting and operations we use service providers whose parent companies are based in the US; processing outside the EU cannot be fully excluded in this context. We safeguard such transfers with appropriate safeguards under Art. 44 et seq. GDPR, in particular the EU Standard Contractual Clauses. You can find which service providers we specifically use and where they process data in our service provider overview.

Your control

You control the processing yourself at any time — by signing out, withdrawing personalization, deleting your profile, or deleting your profile & blocking your email (Part 1, Sec. 9). You control consent to call recording independently of these: for an individual call directly during the call, and generally in your settings or by sending a message to datenschutz@seibert.group (Part 1, Sec. 6).

Data Protection Officer

Stephan Hansen-Oest, Im Tal 10a, 24939 Flensburg, Germany, dsb@seibert.group

Your rights

Access, rectification, erasure, restriction, objection, and data portability — within the scope of the applicable statutory requirements. For non-written requests for information, we may require proof of identity. You have the right to lodge a complaint with a data protection supervisory authority.

Retention period and deletion

We store your data for as long as your account exists or as is necessary for the purposes described, and in accordance with statutory retention obligations (e.g. invoices). The following applies additionally to call recordings: we delete the audio recording no later than 30 days after the call; we keep the transcript and analysis in our CRM for the duration of the business relationship and delete them afterwards, unless statutory retention obligations require otherwise. At your request, we delete the recording, transcript, and analysis earlier. You can delete your account yourself at any time; we will then remove your data unless retention obligations require otherwise. If you additionally choose to block your email address, we retain only that address, in blocked form, to implement your exclusion request (Art. 6(1)(f) GDPR); we lift the block upon your request.

Changes to these privacy notices

We revise these notices as needed. The current version is always available on this page.
